Electric and Motorized Scooters Prohibited on CSUB Campus

Purpose:

CSUB prioritizes the safety of the campus community. In accordance with campus and state regulations, electric and motorized scooters may be used to travel to campus but must be lawfully parked on the perimeter of the campus prior to entering upon campus property.
 
Electric and motorized scooters are prohibited to be operated or stored on the CSUB campus. Electric or motorized scooters left unattended on campus will be considered abandoned and subject to impound. Abandoned scooters will be collected on a regular basis. Persons violating campus policy may be cited under California Vehicle Code (CVC) section 21235, Section 42353.1 of Title 5 of the California Code of Regulations, and other applicable laws and regulations, and as a violation of student conduct as being in violation of this policy.
 
Impounded scooters may be subject to administrative fees prior to release to legal owner or designee. 
 
California Vehicle Code section 407.5 defines a “motorized scooter” as any two wheeled device that has handlebars, has a floorboard that is designed to be stood upon when riding, and is powered by an electric motor or by a source other than electrical power. This device may also have a driver seat that does not interfere with the ability of the rider to stand and ride and may be designed to be powered by human propulsion. 

For purposes of this policy, the phrase “electric and motorized scooters” shall have the same meaning as “motorized scooters” in California Vehicle Code section 407.5.  CSUB also recognizes motorized scooters with gasoline engines or other propulsion ability other than the actions of the rider as a prohibited electric and motorized scooter given that they are powered by a source other than electrical power.

As a courtesy to those that ride electric scooters, CVC 21235 states, in pertinent parts:
 
The operator of a motorized scooter shall not do any of the following:
(a) Operate a motorized scooter unless it is equipped with a brake that will enable the operator to make a braked wheel skid on dry, level, clean pavement.
(b) Operate a motorized scooter on a highway with a speed limit in excess of 25 miles per hour unless the motorized scooter is operated within a Class II or Class IV bike way.
(c) Operate a motorized scooter without wearing a properly fitted and fastened bicycle helmet that meets the standards described in Section 21212, if the operator is under 18 years of age.
(d) Operate a motorized scooter without a valid driver’s license or instruction permit.
(e) Operate a motorized scooter with any passengers in addition to the operator.
(f) Operate a motorized scooter carrying any package, bundle, or article that prevents the operator from keeping at least one hand upon the handlebars.
(g) Operate a motorized scooter upon a sidewalk, except as may be necessary to enter or leave adjacent property.
(h) Operate a motorized scooter on the highway with the handlebars raised so that the operator must elevate his or her hands above the level of his or her shoulders in order to grasp the normal steering grip area.
(i) Leave a motorized scooter lying on its side on any sidewalk or park a motorized scooter on a sidewalk in any other position, so that there is not an adequate path for pedestrian traffic.
(j) Attach the motorized scooter or himself or herself while on the roadway, by any means, to any other vehicle on the roadway.
 
Please ride carefully and with all due consideration for the safety and right of others on your way to and from campus. Be very aware of your surroundings as you may not be seen or heard by other vehicles.  Drive cautiously and defensively.
